INFORMATION NOTICE PURSUANT TO AND FOR THE PURPOSES OF ART. 13 OF THE PERSONAL DATA PROTECTION CODE ADOPTED BY LEGISLATIVE DECREE NO. 196 OF 30 JUNE 2003
TO SEE travel & outdoor di Enrico Tirindelli (hereinafter, TO SEE), pursuant to and for the purposes of art. 13 of the personal data protection code adopted by Legislative Decree no. 196 of 30 June 2003 (hereinafter the Code), containing provisions for the protection of persons and other subjects with regard to the processing of personal data, with reference to the personal data it intends to process, provides the user interested in using the information service by e-mail (hereinafter, the Data Subject) with the following information notice.
1. Purposes of processing and nature of the provision of personal data
The personal data collected will be processed, stored and archived by TO SEE for the following purposes:
a. Strictly connected and instrumental purposes: the sending by TO SEE of information by e-mail regarding the tourism and hiking activities promoted by it.
The provision of the personal data marked with an asterisk is mandatory; failure to enter the mandatory data will result in TO SEE refusing to enter the personal details in its database and to provide the information relating to the proposed activities.
b. Purposes connected with information and commercial promotion relating to the development of new services, and to the offer of products and/or the possibility of benefiting from particular advantageous conditions, including through third-party companies, as well as communication to companies specialized in information and commercial promotion or for the purpose of verifying the degree of satisfaction of the Data Subject in relation to the services provided by TO SEE.
The processing connected with these purposes requires the Data Subject's consent and failure to grant consent to the processing of such data will prevent the sending of information or advertising material or the carrying out of marketing activities and surveys of the Data Subject's degree of satisfaction with reference to the service provided.
2. Methods of data processing
In relation to the purposes indicated, the processing of personal data by TO SEE takes place through manual, computer and telematic tools, organized according to logics related to the same declared purposes and, in any case, in such a way as to guarantee the security and confidentiality of the data processed. Personal data are stored and archived using both electronic and computer tools and specific paper archives.
3. Categories of subjects to whom personal data may be communicated or who may become aware of them as data processors or persons in charge of processing
3.1. The personal data collected may, without the need for the Data Subject's consent, in fulfillment of obligations provided for by laws, regulations or European Community rules, be communicated to the subjects identified by those rules.
3.2. The personal data collected may also be communicated to the categories of subjects who carry out activities connected and instrumental to the provision of the services present on the site and to the carrying out of TO SEE's activity, or may be known by them in their capacity as data processors appointed by TO SEE. These categories include the subjects who, by way of example and without limitation, carry out the following activities:
- hosting services;
- storage and archiving of personal data from documents or media supplied by or originating from the Users themselves.
3.3. Personal data may be communicated to third-party companies that have entered into commercial agreements with TO SEE and specialize in promotional, marketing and commercial information activities, and in detecting the quality of the services provided by TO SEE.
Failure by the Data Subject to consent to communications to the subjects mentioned above could, in some cases, make it practically impossible for TO SEE to provide the requested services.
3.4. Some categories of subjects, as persons in charge of processing, may access the Data Subject's data in order to fulfill the duties and tasks assigned to them. In particular, TO SEE has appointed or may appoint its employees, as well as its consultants and collaborators, to process the data. Likewise, the subjects designated by TO SEE as data processors may become aware of the Data Subject's data in relation to the performance of the tasks assigned to them.
3.5. Personal data may also be communicated to subsidiaries and/or associated companies or companies otherwise belonging to the same group as TO SEE.
3.6. TO SEE does not disseminate the personal data it processes.
The Data Subject may at any time ask TO SEE to know the exact identity, company name or corporate name of the subjects to whom TO SEE communicates personal data concerning them.
4. Rights of the Data Subject
Art. 7 of the Code grants the Data Subject specific rights, including the right to obtain from the data controller confirmation as to whether or not personal data concerning them exist and to have such data made available in intelligible form; to know the origin of the data, as well as the logic and purposes on which the processing is based; to obtain the erasure, anonymization or blocking of data processed in breach of the law, as well as the updating, rectification or, where there is an interest, integration of the data; and to object, for legitimate reasons, to the processing itself.
The rights referred to in this paragraph may be exercised by making a request, without formalities, to the Data Controller or to the processor, also through a person in charge, and sent to the address of TO SEE's registered office by registered letter, fax or e-mail. With regard to the exercise of the rights referred to in art. 7, paragraphs 1 and 2, of the Code, the request may also be made orally.
For each request for confirmation as to whether or not personal data concerning the Data Subject exist, where the existence of such data is not confirmed, the Data Subject may be asked for a contribution to expenses, not exceeding the costs actually incurred, according to the methods and within the limits established by the Italian Data Protection Authority.
5. Data Controller and Data Processor
The Data Controller of the personal data collected is TO SEE travel & outdoor, in the person of its legal representative pro tempore, with registered office in Volpago del Montello (TV), via Schiavonesca Nuova, 104, telephone no. 328 0175442, e-mail mail@tosee.it.
The constantly updated list containing the identification data of the Data Processor is available at TO SEE's registered office.
Having read and understood the information notice provided by TO SEE travel & outdoor di Tirindelli Enrico, and having taken note of its contents, I declare that I have been informed about:
the purpose of the processing of personal data and the methods of such processing, as specified in the information notice above;
the mandatory nature of providing the data referred to in point 1. a);
the subjects to whom the data may be communicated and disseminated and the subjects who may become aware of the data as processors or persons in charge, always within the scope of carrying out the same processing;
the rights granted to me under art. 7 of the Code;
the Data Controller and the Data Processors.
All this being stated, pursuant to art. 23 and art. 25 of the Code, I give my consent to the collection, processing and communication of data connected and instrumental to the provision of the Service and to the execution of my requests. Pursuant to arts. 23 and 25 of the Code, with reference to the collection, processing and communication of personal data for information and commercial promotion purposes, as well as to the communication of the data themselves to companies specialized in information and commercial promotion and to companies controlled by and/or associated with the Data Controller, aware that giving consent to processing aimed at pursuing such purposes is not mandatory, but that failure to express consent may prevent the provision of some services, or, in any case, prejudice their optimal provision.
